EXHIBIT "A"    BNSF employee  graffiti's  3 feet x 3 feet, inside a bnsf terminal, this remained on the wall APPROX A WEEK. Police initiate the removal of this graffiti by the BNSF after many failed requests from the plaintiff.

This graffiti was written across a wall at a BNSF terminal in Sioux City, Iowa by a 52-year old BNSF conductor, Gary Buntemeyer ( defendant)  This phone number was the unlisted unpublished phone number of Buntemeyer's ex-wife, who lived in Nebraska. Buntemeyer solicited BNSF employee's
to call his ex-wife for sexual intercourse through graffiti writings at his place of employment.(BNSF)
 
 
After numerous threatening, untraceable, unsolicited phone calls,  Buntemeyer's ex-wife contacted the BNSF and the BNSF HOTLINE many times and asked that the graffiti be removed.
 
She called ( BNSF POLICE) Senior Special Agent Neb. Div., who said,  "they scoured the terminal and there was no graffiti written anywhere" Note:  The above graffiti was 3 feet by 3 feet 
BNSF lied. BNSF did not bother to look for the graffiti, because they thought it was not important. 
 
The following week, she contacted the  Sioux City Police Dept.  The Police dept. documented the graffiti, investigated BNSF agents and the BNSF employee. THE POLICE DEPT. THEN GAVE BNSF 24 HOURS TO REMOVE WHAT THEIR EMPLOYEE HAD WRITTEN OR BE CHARGED WITH CRIMINAL HARASSMENT.
 
Speaking of public safety!!.....Buntemeyer's Engineer and good friend, Keith Herald, BNSF ENGINEER (who worked with Buntemeyer the day he wrote the grafitti) is now in PRISON for possessing the largest collection of CHILD PORNOGRAPHY in the history of Lancaster County. (250,000 pictures of children engaging in sexual intercourse) BNSF engineer Herald stalked hundreds of children at parks, swimming pools, and schools and photographed them. Herald is considered DANGEROUS because he sought out live victims. BUNTEMEYER HIMSELF HAD JUST COMPLETED A YEAR OF CRIMINAL PROBATION  RESULTING FROM child ABUSE AND ASSAULT CHARGES           ( Why would the BNSF pride themselves on public safety???)

The victim/plaintiff (not the BNSF) hired a forensic document examiner who concluded the handwriting to be that of Mr. Buntemeyer. The same employee the BNSF stated was innocent,... was infact the criminal. The defendant admitted to all of the allegations in the complaint which is now public record. CI05-441 ( complaint page)
 
  Defendant escaped "criminal" charges by the "statute of limitations" and lying to the police.
 
Buntemeyer continues his close relationship and employment with the BNSF and hopes to become a supervisor in upper management at the BNSF.  ( Buntemeyer has applied for this position many times)
 
 
 
OTHER INAPPROPRIATE ONGOING BNSF GRAFFITI: 
 
 
 
More graffiti about the plaintiff was written on BNSF engine's No. 5352, No. 4162, No. 9769, No. 8885, No. 8853, No. 9537, No. 9479, No. 9537, No. 9433 and possibly more.
 
A BNSF conductor stated he waited two hours after his tie-up time on an engine for a supervisor to come & observe graffiti that referred to his friend by name (a BNSF employee) stating that he was a "FAGGOT"  
 
A BNSF engineer had graffiti written about him in a Lincoln BNSF terminal that stated he was a "CUM GUZZELEN COCKSUCKER".  When the engineer was asked by a conductor why he didn't turn the graffiti in, he stated "the BNSF won't do anything about it other than possibly paint over it."  The following month the graffiti was painted over and the following week, new graffiti appeared with his name stating "all the paint in the world can't cover up the fact that (name) is a CUM GUZZELEN COCK SUCKER"
 
Another BNSF employee stated several times at work he would observe graffiti written on his locker "BLOW ME"   
 
A woman who was referred to by first and last name "HAS A DEEP ASS AND HOLE" was written inside dozens of BNSF engines. (poor Margaret Morgan)
